Terms of Service & Rental Agreement

These Terms of Service and this Rental Agreement (together, the "Terms") govern your use of this website and any stay at the The Skyfall Residence residence in Wildwood Reserve, Park City area, Utah (the "Residence"). The Residence is owned and offered by RRR LLC, a Utah limited liability company ("we," "us," or "RRR"). By submitting a reservation request, paying a deposit, or staying at the Residence, you (the "Guest") agree to these Terms.

1. Reservations & Confirmation

All stays are by request. A submitted request is an offer to book, not a confirmed reservation. A reservation exists only once our reservations team personally confirms it in writing and, where applicable, the initial deposit is received. Nothing is charged until your reservation is confirmed. We may decline any request at our discretion consistent with applicable law.

The primary guest must be at least 25 years old, must be present throughout the stay, and is responsible for the conduct of all occupants and visitors. We may require government-issued identification and a signed copy of this agreement before confirming a stay.

2. Rates, Payment & Taxes

Nightly rates are seasonal and are shown, together with the cleaning fee and applicable Utah state and local lodging taxes, before you submit a request. Unless otherwise agreed in writing: a deposit of 50% of the total is due upon confirmation; the balance is due 60 days before arrival; reservations made within 60 days of arrival are payable in full at confirmation. Quoted totals are for the Residence as a whole โ€” it is never shared with other parties.

3. Cancellations & Travel Insurance

Winter travel in the Wasatch Back is weather-dependent. We strongly recommend travel insurance for all stays, and particularly for ski-season and holiday reservations.

4. Security Hold & Damage

A refundable security hold is arranged before arrival. The Guest is responsible for any loss or damage to the Residence, its furnishings, and Wildwood Reserve common areas caused by the Guest's party beyond normal wear and tear, and authorizes us to apply the security hold to such amounts. Liability for damage is not limited to the amount of the hold. Missing items, extraordinary cleaning, smoking remediation, and unauthorized-pet remediation are charged at cost plus a reasonable administrative fee.

5. Occupancy & House Rules

Material violation of these rules is grounds for immediate termination of the stay without refund, to the extent permitted by law.

6. Pool, Spa & Assumption of Risk

The Residence includes a private sauna and hot tub; the heated pool and spa are shared amenities of Wildwood Reserve, located steps from the Residence and governed by the Reserve's posted rules and hours. Certain Reserve amenities and services (including the shared pool and spa, and the ski shuttle) are subject to completion and seasonal schedules โ€” current availability is stated on the listing at the time of booking. There is no lifeguard on duty. Use of the pool, spa, sauna, hot tub, decks, and surrounding areas is entirely at the Guest's own risk. Children must be actively supervised by an adult in and around the water at all times. Persons who are pregnant, have heart conditions, or take medications affected by heat should consult a physician before using the spa. Glass is prohibited in pool and spa areas.

The Residence sits at roughly 6,800 feet of elevation in mountain terrain. Guests assume the ordinary risks of a mountain environment, including altitude effects, winter driving conditions, snow and ice on walkways and decks, wildlife, and rapidly changing weather. A 4WD or AWD vehicle with appropriate tires is strongly recommended between November and April.

7. Shuttle & Third-Party Services

Ski shuttle service, private chefs, equipment delivery, and similar concierge-arranged services are provided by independent third parties. We arrange these services as a courtesy; the providers are solely responsible for their performance, and your use of them is subject to their terms and at your own risk.

8. Our Access to the Residence

We and our service providers may enter the Residence during a stay for emergency, safety, or essential repairs, and for scheduled services (such as housekeeping or hot-tub maintenance) with advance notice where practicable.

9. Limitation of Liability & Indemnification

To the maximum extent permitted by Utah law: (a) the Residence and all amenities are provided "as is"; (b) RRR LLC, its members, managers, and agents are not liable for indirect, incidental, consequential, or punitive damages, or for loss or theft of Guest property or vehicles; and (c) our total aggregate liability arising out of or relating to a stay shall not exceed the total amounts paid by the Guest for that stay. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for our own gross negligence or willful misconduct.

The Guest agrees to indemnify and hold harmless RRR LLC and its members, managers, and agents from claims, damages, and costs (including reasonable attorneys' fees) arising from the Guest's party's use of the Residence or the Reserve's amenities, breach of these Terms, or violation of law, except to the extent caused by our gross negligence or willful misconduct.

10. Force Majeure

Neither party is liable for failure to perform caused by events beyond its reasonable control, including natural disasters, wildfire, government orders, utility failures, or pandemics. If such an event makes the Residence uninhabitable for confirmed dates, our sole obligation is to refund amounts paid for the affected nights.

11. Website Use

This website and its content (text, photography, design) are the property of RRR LLC and may not be copied or scraped for commercial purposes. Reservation codes are personal to the requesting guest; do not share them. You agree not to submit false reservation requests or to interfere with the site's operation.

12. General

These Terms are governed by the laws of the State of Utah. Any dispute shall be brought in the state or federal courts located in Summit County, Utah, and the parties consent to their jurisdiction. If any provision is held unenforceable, the remainder continues in effect. These Terms, together with your confirmed reservation details and any signed rental agreement, are the entire agreement between you and RRR LLC regarding your stay. We may update these Terms from time to time; the version in effect when your reservation is confirmed governs that stay.
